How to make a Bequest
A bequest enables you to provide for family and friends, and at the same time make a lasting gift to the cause that is important to you.
To make a bequest, you must have a clearly written and up-to-date Will. A Will must comply with certain legal requirements, so we advise you to consult a solicitor.
Once you have decided to include Diabetes ACT in your estate planning, you will need to give some consideration to the type of bequest you will make. There are a number you can consider.
What kind of Bequest?
Residual bequest
A residual bequest is one where you provide for your family and friends first and leave what is left – the residue - to Diabetes ACT Ltd As your estate increases in value, so does your bequest. You won’t need to remake your Will to compensate, for example, for the effects of inflation.
Property, insurance, shares
Diabetes ACT is able to accept all forms of property and shares and can be the sole beneficiary of a life insurance policy. Some people also choose to leave a specific item, such as a painting or valuables.
Contingency Bequest
Establishing a trust in your Will allows a spouse or other person to use your property and to receive all of the income derived from your estate during their lifetime. When they die, the capital and interest can then be passed on to Diabetes ACT Ltd.
Specific Sum
A specific cash sum is a common form of bequest but does allow for inflation. Should you leave a cash sum to Diabetes ACT Ltd, you may like to regularly review your Will.
If you wish to leave a gift to Diabetes ACT in your will, the following wording should be used:
“I bequeath to Diabetes ACT Ltd ( ABN 41 671 989 072) located at 27 Mulley Street, Holder ACT 2611 ( a specified sum, or specified items, or the residue of my estate), free of all duties. The receipt of the Secretary or other authorised office shall be a complete and sufficient for the executor(s)”
Legal information
For your bequest to be valid you must use our organisation’s full name, that is, Diabetes ACT LTD. Diabetes ACT LTD is registered in the ACT and is eligible to receive tax deductable donations.
